Claims Made Basis of Cover

Professional Indemnity Insurance for barristers operates on a “claims-made” basis. This means it is the policy in force at the time a claim is first made or when a circumstance is notified that will respond, not the policy in place when the work was originally carried out.

You must notify insurers as soon as you become aware of a claim or potential circumstance. Failure to notify promptly may result in loss of cover. If you are unsure whether a matter should be notified, you should speak with your broker immediately.

Continuous cover is essential. If your policy lapses or is cancelled, you will have no protection for future claims, even if they arise from work completed while previously insured.

Selecting a Limit of Indemnity

All Professional Indemnity Insurance policies are subject to a Limit of Indemnity, which should be reviewed regularly to ensure it reflects the nature and scale of your practice.

The LSRA requires a minimum level of indemnity of €1.5 million per claim. However, depending on your area of practice, exposure and client profile, a higher limit may be appropriate.

Claims arising from the same act, error or omission are generally treated as a single claim, meaning the selected limit represents the maximum amount payable by insurers in respect of those claims.
